Two men were arrested Sunday on felony charges of possession of a stolen vehicle after they were found rummaging through luggage that was in the back of the vehicle they had allegedly stolen, a Carson City sheriff’s deputy said.
Arrested were David Roberson, 63, of Carson City and Kenneth Dean Council, 51, of Idaho. According to the booking report, officers were dispatched at 2:54 p.m. to the area of North Curry and Fleischmann Way after a reporting witness said two men were going through luggage. Officers arrived and saw the vehicle in question had Montana plates. The men told deputies they were from Montana trying to get Arizona, the arrest report states.
As a deputy checked the status of the vehicle, officers noticed the two men became nervous when they were asked questions. Criminal checks were done on the men, with Council having previously been in prison for murder. Roberson’s background check came in clear without any warrants.
The VIN number of the truck came back clear and the men were released from the scene. At 3:24 p.m. dispatch alerted deputies that the National Crime Information Center confirmed the vehicle had been stolen out of Alturas, Calif. Officers returned to the area and found Roberson with a suitcase he was pulling behind him as he walked. Both men were ordered to the ground and arrested.
Roberson told the officer without prompting that “the guy who said the truck is stolen is 5150,” according to the arrest report. In California, 5150 is a term used described someone with mental disorders that could pose a problem to themselves and others.
Both men were taken to jail for booking. Roberson talked during transport and said he wanted to go on the record and say the man who reported the truck stolen was “5150.” He then said he would not say anything more and requested a lawyer, preferably a public defender, the arrest report states. Roberson and Council are each being held on $25,000 bail.
